I'm a level 1 captain inside my faction, which has been a desert place for a while but me. Faction's leader told me he would transfer leadership to me, though he never did it. I have the chance to disband it and I'm wondering if I can claim faction's name after I disband it or the name will be lost. I really want to resurrect my faction and this doubt is the only thing that keeps me from doing it. Thanks in advance for the answer.

If you have the option to disband the Faction, then you have been made the Leader already.

Checking at the faction's info, my current and MIA leader still appears, along with the L after his name... Though I can disband. Maybe I'm a sort of co-leader or first mate at faction level. I just want confirmation before messing and loosing the name
I am sure (99.9% at least) that once disbanded, the faction name will be free again.
Once you disband, make sure your character data saves, then you can remake it, making sure it saves again.
If you do go ahead and disband it, then try to reform it, please let us know if it worked for you or not. That would be valuable information, I'm sure.

Yes, it is freed up if you disband the faction, mine has been reformed to get rid of inactive rank 1s, and we're still here 

I can second (third?) that. Your faction name becomes available as soon as it's disbanded. We of The Watchmen had to do that a long long time back to clear out an inactive rank 1 (and hence, have decided to never have multiple rank 1's again hehe).
Thanks everybody for your answers. Nevertheless, I found out that even though I'm a rank 1 captain and have the option to disband the faction, I can't do it. I get the system's message of Disbanding Faction after confirming its disbanding, but nothing happens. If I can't get some Admin to do it for me, then it means the end of an age. Hope to have it solved soon.
One possibility is to have every single crew but the inactive one leave the faction. As a faction requires at least 2 crews to exist, the faction will disband automatically if there's only one crew left. Another option if you can't get the faction to disband is to basically use the same name but just add a "The" to the name or something like that.
Either way, be sure to do what LtCmdr_Tsusai said: make sure your character data saves (and ideally everyone in your faction who's in-game at the time). Only after that's happened should you try to reform the faction.
