I should just point out that the Assassin wasn't just a program, he was a Machine: he was a robot that dealt with the disposal of waste, and among other duties was sent (meaning he has a physical presence) to recycle Trinity after the hovercraft crashed in Revolutions.
Every Machine has a mind, and given their construction you could consider their minds to be 'programs'. How they separate from their physical, mechanical bodies and enter the Matrix (and survive) is beyond me, but it evidently happens.
