Im one of those who wont attack someone without good reason (namely being attacked) that being said is there is a pvp battle actally happening, then either stay away from the construct and come back later or participate 
I dont find it right to just attack someone espically if they are there for xp (come on we all know thats a good way fo getting it there), there is a peace between machines and humans, so your saying we can be at peace too?
To be honest this kind of issue comes up a bit and hard valid points from both sides, the only real thing I think the devs can do and should do, is to take away the boss, and then remove the ability to pvp outside the construct (unless needed for live events etc), that way people who really want to pvp will goto the constructs and those who want xp will have to hit other areas, as for those rare drops, spread them about, make different boss drop random stuff even.....
Thats my suggestion in the matter...
